6.4 Overtime – Non-Exempt Employee

On occasion, we may ask you to work beyond your regularly scheduled hours. We expect you to work a reasonable amount of additional time: this flexibility is a job requirement. We will try to give you advance notice when overtime work is necessary; however, it will not always be possible to notify you in advance.

Only time actually spent working counts as hours worked towards the overtime threshold. Paid sick leave or any other paid time during which you did not actually work will not count as hours worked towards this threshold.

  • Exempt employees who work for more than their salaried hours in one pay period are permitted to take that time off in the following pay period as part of their salaried pay.
  • Non-exempt employees are entitled to payment for overtime, according to the rules set forth below, and as prescribed by the Fair Labor Standards Act. (For information on which employees are exempt and which are non-exempt, see Section 5 of this Handbook.)
  • All overtime work must be approved by your supervisor. Working overtime without permission violates company policy and may result in disciplinary action.
  • For purposes of calculating how many hours you have worked in a day or week, our work week begins at 12:00 a.m. on Saturday and ends at midnight on Friday. Our work day begins at 12:00 a.m. and ends at midnight each day.
  • Non-exempt employees will be paid one and a half times their regular hourly rate of pay for every hour worked in excess of eight hours per day and in excess of 40 hours per week. Non-exempt employees will be paid two times their regular hourly wage for hours worked beyond 12 hours in a day.
  • California non-exempt employees are also paid 1½ times their regular hourly rate of pay for the first eight hours worked on the seventh consecutive day of work, and two times their regular hourly wage for working more than twelve hours on a day and for working more than eight hours on a seventh consecutive work day.
